Tony Schwartz

Tony has practised in broad areas of law, but with a particular interest and speciality in liquor licensing matters since his admission as a solicitor in 1979. Tony was previously a partner at Corrs Chambers Westgarth solicitors where he worked for over 8 years from 1985 to 1993. From 1979 to 1985 he was a senior associate at Brady Donald and Co, a specialist liquor and club law firm.   In 1993 Tony formed Back Schwartz Vaughan Solicitors with Frank Back with the intention of developing a comprehensive liquor and property based practice that would satisfy the needs and requirements of industry members in a cost effective manner.

The cornerstone of Tony's expertise and recognition in the provision of legal services to the liquor, hospitality and gaming industry is his contribution to education and technical legal services as the principal author of the liquor licensing publication McDonald's Licensing Laws of New South Wales. Tony has been the author of this publication since 1990. It is used and relied upon by other solicitors, the Police service, Magistrates and Officers of the former Licensing Court and Liquor Administration Board and the Officers of the Casino, Liquor & Gaming Control Authority.

Tony continues to provide support, training and advice to other practitioners on liquor and gaming related matters. He regularly delivers lectures on licensing law to solicitors through the Young Lawyers of NSW College of Law, CLE Centre Limited and to private client groups. He has also provided instruction in relation to the restaurant licensees course conducted by the New South Wales Tourism Employment and Training Corporation. Tony is well regarded in the legal profession as an expert witness in proceedings involving liquor licensing practice and procedure. He regularly acts for other legal practitioners so that their clients receive specialised advice on liquor and gaming matters.

Tony has been involved in the major investigations, complaints and prosecutions instigated by the Police or Director of Liquor and Gaming and has impressively represented the applicant or submitter in more social impact assessments before the former Liquor Administration Board than any other legal adviser in NSW.

Tony and his staff have been involved in many of the recent cases in the Supreme Court involving the Liquor Act, the Registered Clubs Act and the Gaming Machines Act. Tony has also been involved in many liquor and gaming matters before the Land and Environment Court involving hotels and other licensed premises. Such proceedings have involved lease disputes, poker machine entitlement issues, extension of trading hours, smoking areas and disputes involving restrictive conditions imposed by Councils or local consent authorities.

Tony is sought after by those in the industry to assist in the most difficult, complicated and complex legal matters. Tony has been successful in achieving his goals and holds a solid reputation for providing cost effective and timely liquor and gaming solutions to those in the industry. Tony is committed to every client's individual needs and requirements and is well regarded for his ability to provide prompt and accurate advice.

Tony's clients include restaurateurs, hoteliers, bottleshop operators, registered club operators, nightclub operators, caterers, wholesalers, vignerons, international hotel operators, resort operators, developers, and operators of chains of licensed premises such as Woolworths Limited. Tony has significant experience in community impact statements and the social impacts to be considered. Tony has represented the interests of Woolworths Limited in their licensed premises throughout New South Wales for over 10 years, which includes brand names Woolworths Liquor, BWS Beer Wine Spirits, Safeway Liquor and Dan Murphy's. Tony also represents the interests of other chains of hotel and liquor operators in NSW in relation to their compliance issues and acquisitions as well as some of the major registered clubs in NSW.
