Changes to Outdoor Dining Applications for Change of Boundaries

A fast-track application process has been established by the NSW Government for existing premises.

There are now two ‘Pathways’ available for businesses to apply for a ‘temporary change of boundaries for footpaths and roads’ subject to the type of land to be used for outdoor dining and whether council approval is required.

Pathway 1: Outdoor dining on footpaths and roads

  • Council approval is required here, and applicants must complete the ‘Liquor licence temporary change of boundaries – footpaths and roads’ form which can be requested from Council and returned for their review.

  • Applications for this type of temporary liquor licence boundary change are generally approved by Liquor & Gaming NSW within 3 days and the usual fee has been waived.

Pathway 2: Outdoor dining on other types of land (not footpaths or roads)

  • This pathway is for private and public land, such as bowling greens and carparks, adjacent to licensed premises. Under the Government’s emergency temporary alfresco measures in place initially until April 2022, then extended to 30 June 2022 and now to 31 December 2023, outdoor dining on this type of land, typically, will not require council approval. If you are uncertain whether Council approval is required, please contact your Council for direction.

  • Applications for this type of temporary liquor licence boundary change are generally approved by Liquor and Gaming NSW within 10 days and the usual fee has been waived.

If you have been operating with a temporary change of boundary for 12-months or more, excluding any COVID lockdown periods, you may be eligible to apply for a fast-tracked permanent change of boundaries.
