Dan Murphy's - Lake Haven

We are delighted to have assisted Woolworths and Endeavour in their successful application before the NSW Liquor and Gaming and the NSW Independent Liquor and Gaming Authority to change the licensed boundaries of their existing BWS Store in Lake Haven.  The approval allows a future Dan Murphy’s store to operate in its place.  The process involved the Department requesting for the first time in these circumstances the completion of a Category B Community Impact Statement (CIS) that evaluated the likely impact of increasing the licensed area of the BWS Store, and trading under the larger Dan Murphy’s model. The Department and Authority also commissioned its own consultants and communicated directly with stakeholders seeking their input into the Application.  The decision by the Board Members of the Authority to grant the Application is significant due to their previous decisions to refuse new packaged liquor licence applications in Lake Haven.  The team at BSV were able to obtain and provide evidence to the Authority that the overall social impact of the proposal would not be detrimental to either the local or broader communities.  After the lodgement of this Application with the Authority, it issued a new Guideline 14 that states (amongst other things) applicants who wish to increase their licence boundaries by more than 50% are now required to complete a Category B CIS (if a CISB was provided with the original licence application or would currently be required for an application of this type).  The Authority considers such applications to represent a change in business model, and that consultation with the community through a CISB would better inform the decision making process.  The very experienced team at BSV regularly addresses social impacts associated with NSW liquor licences.   If you are considering increasing the licensed boundaries of your premises then the team at BSV are ready to assist.
