Ceasing to Trade - Dormant Licences

It is important to consider the steps to be taken when a licensed business ceases to trade. As one example, BSV acts for a licensee who closed their bottleshop at the end of their lease when the business vacated the tenancy. The required Cease to Trade Form was lodged with the NSW Liquor and Gaming, advising that Department the packaged liquor licence had ceased business operations and was now dormant. Unfortunately, the new tenant (supported by the freehold owner) took steps to take possession of the liquor licence to the exclusion of our client. In a challenging situation, the highly experienced team at BSV prevented this outcome. While the liquor licence is “parked” in a dormant capacity in the same location, the boundaries of its approved licensed area now occupy a small but unusable space in the same location. The BSV team have also commenced the process to remove the licence to a new location.
